Terms of Service

Agreement

By creating an account or using DraftTrack, you agree to these Terms of Service. If you do not agree, do not use the service. These terms form a binding agreement between you and Tapworks Northwest, the operator of DraftTrack.

The service

DraftTrack is a web-based business management tool for draft line cleaning operations. It provides scheduling, estimating, client management, and line build documentation features. We reserve the right to modify, update, or discontinue features at any time, and will provide reasonable notice of significant changes.

Your account

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and up to date
• Notifying us immediately of any unauthorized access to your account

You may not share your account with others or create accounts on behalf of third parties without our permission.

Acceptable use

You agree to use DraftTrack only for lawful purposes related to operating a draft line cleaning business. You may not:

• Use the service to store or transmit illegal content
• Attempt to gain unauthorized access to the platform or other accounts
• Reverse engineer, copy, or resell the service or its underlying code
• Use automated tools to scrape or extract data from the platform
• Interfere with or disrupt the integrity or performance of the service
• Use the service for any purpose other than managing a draft line cleaning operation

Payment and billing

DraftTrack is a paid subscription service. By subscribing you authorize us to charge your payment method on a recurring basis at the rate you selected at signup.

• Subscriptions renew automatically unless cancelled before the renewal date
• All payments are processed by Stripe and are subject to Stripe's terms
• We do not offer refunds for partial billing periods
• If a payment fails, we will notify you and provide a grace period to update your payment method before suspending access
• Early access pricing is locked in for the lifetime of your account as long as your subscription remains active and in good standing

Cancellation

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to DraftTrack until that date. After cancellation your data will be retained for 30 days and then permanently deleted. You may request a data export before deletion.

Your data

You own your business data — your clients, estimates, schedules, line builds, and pricing. By using DraftTrack you grant us a limited license to store and process that data solely for the purpose of providing the service to you. We do not claim ownership of your business data and will not use it for any other purpose.

Our intellectual property

DraftTrack — including its code, design, features, and branding — is owned by Tapworks Northwest. These terms do not grant you any rights to our intellectual property except the limited right to use the service as described here.

Availability and uptime

We aim to keep DraftTrack available and reliable, but we do not guarantee uninterrupted service. We may perform maintenance, experience outages, or need to take the service offline for technical reasons. We will provide advance notice of planned downtime when possible.

We are not liable for any losses arising from service interruptions, data loss, or downtime, whether planned or unplanned.

Disclaimer of warranties

DraftTrack is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, uninterrupted, or completely secure. Your use of the service is at your own risk.

Limitation of liability

To the maximum extent permitted by law, Tapworks Northwest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of DraftTrack — including but not limited to loss of data, loss of revenue, or business interruption — even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the three months preceding the claim.

Termination

We may suspend or terminate your account at our discretion if you violate these terms, fail to pay, or engage in conduct that we determine is harmful to the service or other users. We will provide notice when reasonably possible. Upon termination you lose access to the service and your data will be deleted after the retention period described above.

Changes to these terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Your continued use of DraftTrack after changes take effect constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the state of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Skagit County, Washington.
